Colorado is a “No Fault Divorce state.” There are just a few exceptions to the “No Fault” law. As such, fault is not a factor when determining how marital property, debts and assets will be divided. While some couples can reach an agreement as to how to divide their marital estate, other couples struggle to reach a fair agreement, and must have a judge decide their case.

When divorcing couples cannot agree on how to equitably end their marriage, it is called a contested divorce. The process of filing a no fault contested divorce in the state of Colorado is the same as an uncontested divorce. It all begins with the filing of a Petition and Summons, which may be filed individually or jointly.

Once the Petition and Summons is filed with the court, the couples must wait 90 days before they can proceed with finalizing their divorce. After this 90 day period, an uncontested divorce typically finalizes shortly thereafter, while a contested divorce can take many more months to finalize.
